Sure, but there are several ways to consider an assert.
In luatex we tend to use it to mark a condition that should be discussed
(as we are doing now)
and finally removed,  i.e. replaced by an error  or  solved by a fix.
The part of the code is the same in 1.10 and 1.12 but
[luatex] Assertion from texlang.c with reproducible example
is ok with 1.10
while now we know the plain luatex fails in both cases.
