[XeTeX] %&-parsing problem?

If I have this in a TeX file:

%&xetex

\special{color cmyk .2 1 .5 .1}%

\nopagenumbers

$$\vbox\bgroup\tabskip1em%
\let\par=\cr%
\obeylines%
\halign{% Note no \cr
#\hfil&\hfil#\hfil&\hfil#&&\hfil**#**

I get this in the console:

I think this was working before, and it continues to work if I use %&latex for example.
