[XeTeX] Odd error with XeLaTeX and TL2008

It looks like the LM font filenames have changed; what I see now in TL  
is "lmromancaps10-regular" rather than "lmroman10-capsregular".

I notice you have a copy of fontspec in texmf-local; try removing/ 
hiding this, and see if the one in TeX Live matches the fonts that are  
actually present.
