I'm no expert on interpreting the GNU licences, but it seems to me that 
such a LaTeX document would be no less "transparent" than any other 
LaTeX document that may contain a few custom \newcommand's, extra font 
declarations, etc., in the preamble. It's still simply text with 
visible markup that can readily be understood by reading the textual 
markup, possibly with reference to publicly-available documentation (in 
the case of XeTeX, that's primarily the XeTeX Notes document and the 
archives of this list, at present; but I certainly don't think any of 
it is on a par with undocumented proprietary formats or markup).
