Hi,

I  created myminitoc.sty in the local tree, removed the single
\unpenalty, run texhash and everything works still without this nasty
error message. 
There is in latexcommunity.org a fellow called alicehs who had the same
problem in 2009, wrote that he had a solution by did not reveal it :(
