    if I change the name of the directory to something that does not
    start with . like `build`, both commands run successfully.

Indeed, there is a second restriction: names can't start with ".",
with either openout_any=r or =p. Much too much chance of planting
trojans. From texmf.cnf:
% a (any)        : any file can be opened.
% r (restricted) : disallow opening dot files
% p (paranoid)   : as `r' and disallow going to parent directories, and
%                  restrict absolute paths to be under $TEXMFOUTPUT.
