pdfsync was known to interfere with the output routine and  
distribution of vertical spaces, and in particular with placement of  
marginpars. So the behaviour you report is not much of a suprise. It  
is strange, though, that you didn't get it with earlier versions of TeX.

Anyway, as already pointed out by Retif, you don't need it any more.
