This has nothing at all to do with Windows. Unicode BOMs are defined by the Unicode standard, and every Unicode-capable application may choose to use them.

No, Vim recognizes the BOM as well. BOMs are not "characters" or "bogus bytes", but provide a mechanism to identify the encoding form of a text file where no higher-level protocol supplies information about the encoding.
