[XeTeX] Error using Memoir Class

You are mixing two versions of memoir. memoir.cls and mem10 are in
the current directory. mempatch comes from the texmf-tree. It is
obviously not suited for you memoir version. The current
mempatch.sty has no content and no line 67:
