As for the license:

"You may not unbundle or repackage the Software for distribution, transfer or resale."

A XeTeX-generated document using a font does not distribute, transfer or resale that font, particularly when you embed only the subset of glyphs you use in the document (even if you embed the whole font, it's hard to be used for other purposes).

"You may convert and install the font software into another format for use in other environments, [...] Such converted font software may be used only for
your own customary internal business or personal use and may not be distributed or transferred for any purpose, [...]"

As I'm using it for academic purposes, it seems to fit the permitted uses. There is even a LaTeX package {MinionPro} to use that font, but the package does not come with the font itself, since redistribution is not allowed by the license. It's the same case with Cyberbit CJK font, it can be freely downloaded and used, but no TeX distribution contains the font file itself as there is no license that allows redistribution.

Their license says in short it's allowed to use them for preview and  
it's allowed to embed them in a document. Details can be obtained  
from http://www.adobe.com/type/browser/legal/index.html.

It's probably not allowed to distribute and to alter them or make  
money with them.
