I'm not 100% sure, but I think TeXShop may be quite fussy about  
spaces in these special comments. Try including a space both before  
and after the "=" sign:

> %!TEX TS-program = xetex

and see if that makes it more reliable for you.

(Dick, if you're listening: could TeXShop be made more tolerant of  
variations in spacing here?)
