Yep, but lang.patterns could check the lccodes just as \patterns does (or more
precisely, doesn't, with LuaTeX).

Nope, the primary concern was category codes: this is not really related to
hyphenation, but a general robustness problem for macros executed at an
arbitrary time form a latex document.
